If you were wondering why you haven't seen any additional articles from us in the pending Alex Saab Moran appeal to the Eleventh Circuit, his attorneys have obtained two extensions of time to respond to the question of whether the Court has jurisdiction to entertain an interlocutory appeal. Remember, the District Court decision to deny Saab's Motion to Dismiss on the grounds that he has diplomatic immunity from prosecution was not a final judgment or order, and there are only a small number of appeals permitted from non-final orders.
We cannot express an opinion as to whether these extensions, of which the second one, which required Court approval, were applied for due to problems with the lawyers' caseload, or for some other strategic, reason, for lack of information. In any event, it is possible that the Court will decline to hear the appeal, and we shall monitor the case and report back to our readers on all developments as they occur.
