The United States Supreme Court today granted the petition of the Turkish government-owned HALKBANK to consider whether the bank can be charged with with violating Iran sanctions in a criminal case, in light of the Foreign Sovereign Immunities Act, and the Commercial Activity Exception. Both the US District Court (SDNY) and the Second Circuit Court of Appeals have ruled against the bank in prior decisions on these issues.
