If you read that recent article in IMI Daily, you know that there is serious concern about the financial exposure of purchasers of CBI passports during the application period. Unfortunately, the article glossed over the important post-purchase period, when that has become the most critical stage. What do CBI passport holders do when the EU, acting on the position taken by the European Commission, revokes visa-free travel for CBI?
Wealthy consumers, having just lost most of the value of their six figure purchase, will most certainly consult legal counsel, for the purposes of demanding refunds from the agents who sold them the product, but who will then decline to assist, and litigation will most definitely ensue. Inasmuch as venue is most appropriate in the UAE, where many of these companies have their principal place of business, it is expected that we will be a flurry of lawsuits against the most active CBI consultancies right after the EU either rules, or the Fall 2026 implementation of ESTA results in the disqualification of Caribbean CBI passport holders for entry.
Law firms in Dubai should anticipate a major increase in the number of referrals for this type of litigation, and we will be watchinng.
