It is unfortunate that Simon Mercieca misquoted me by saying that I agreed with him, to the effect that Yorgen Fenech was framed for the assassination of Daphne Caruana Galizia. I said no such thing, and do not agree with anyone taking that position; my article asked questions and published a response. Nobody has, to date, acquired suficient evidence to prove that any third parties framed, or attempted to frame, Mr. Fenech for any crime. That quest for information is still ongoing. Simon Mercieca, whose reputation for objectivity leaves a lot to be desired, got it wrong.

While I am one of those seeking to uncover the truth about Joseph Muscat's actions, regarding Fenech's allegations, I have not reached any conclusions.
I do NOT share Simon Mercieca's position about the subject. He should delete that statement from his blog.
This letter was shared with me and it should be required reading; readers who are compliance officers at international banks should carefully review the text of the letter and the attachments. Some compliance officers properly continue to redline all Latvian banks as extremely high risk, and that prudent action has saved many of their banks' clients from serious losses. This is an international fraud, and one of the banks named is ABLV, which many of our Malta readers will recognize, because that bank was involved with money laundering tied in with Malta.

We are pleased to report that, in connection with our policy of presenting both sides of all issues, as an objective observer, we have spoken directly with Charles Mercieca, the principal defence attorney for Yorgen Fenech in the Daphne Caruana Galizia homicide investigation. The matter we discussed was not related to the innocence or guilt of Mr. Mercieca's client, as that constitutes privileged information, nor did it involve any information covered by the attorney-client privilege.
The sole issued we discussed: whether third parties are seeking to "frame" [implicate] Yorgen Fenech as the principal actor who organized the Galizia murder, directed the individuals who carried it out, and is ultimately to be considered the man who conceived the crime, and directed its execution.
There are many who believe that Joseph Muscat is behind the frame-up plan, and that he has taken affirmative steps to use Fenech as the "fall guy" in the Daphne murder, in order to protect his former Chief of Staff, Keith Schembri. Mr. Mercieca agrees that the evidence appears to point in that direction.
There reportedly was additional "motivation" for JM to move against Fenech: threats allegedly conveyed to him by a representative from Azerbaijan, but who is also believed to be an intelligence operative; He also knows Fenech, but there was a falling out sometime back. We have no further information on the threats conveyed to JM.
Second, he believes that the requisite intent exists. Keith Schembri is known to hold information and documents which are extremely incriminating, to both Joseph Muscat as well as Michelle Muscat, and can certainly result in life sentences for both, should it be disclosed by Schembri to obtain leniency, if he is ultimately found to have been instrumental in Daphne's murder. In the event of Schembri's death, due to illness, those documents will survive, and in the wrong hands could be very damaging to the Muscats. There is the primary reason why Mr. Muscat fears the truth.
How is Muscat remotely accomplishing this covert operation to point fingers at Fenech as the leader of the Daphne assassination plot ? My sources report that Joseph Muscat held what has been described as a secret meeting with a senior politician in the Opposition party, and delegated some of the tasks to him.
Charles Mercieca not only believes that there are powerful forces working with Muscat, but they may very well get away with it, unless publicly exposed. Our sources confirm there are audio recordings out there involving JM and others which must be acquired and made public to solve the puzzle. Obviously, we only know a very small portion of the complete story. As further information comes in, we shall endeavour to follow upon this interesting issue, which could have a major impact on the Daphne trial.
The East Caribbean, whose relative unimportance to American foreign policy leaders is demonstrated by the lack of US Embassies, or even consulates, in most jurisdictions, and a singular failure to bring money laundering and FCPA charges against transnational criminals and corrupt government officials, is being pointedly ignored by the Department of Justice.
Corrupt Citizenship by Investment (CBI) passport programmes, the vast majority of whose applicants are career white-collar criminals, and dodgy Politically Exposed Persons (PEPs) from high-risk countries, are operating worldwide with impunity, as the US DOJ is not indicting them for the crimes they perpetrate using US Dollars, and through American financial institutions.
From St. Kitts and Nevis in the north, through Antigua and Barbuda, Dominica and St. Lucia, to Grenada in the south, criminals in the East Caribbean states ply their illicit trade, ably assisted by corrupt senior local officials, prime ministers, bankers and ambitious CBI consultancies. Only St. Lucia appears to be seeking true reform; all the others continue to constitute Clear and Present Dangers.
Some of the criminal conduct have reportedly been under criminal investigation for as long as five years. While such long-term Federal investigations typically take a substantial period of time to be completed, are politics interfering with the prompt administration of justice ? The United States has arrested, and convicted, the national leaders of Panama and the Turks and Caicos Islands, so there should not be any hesitation over international political fallout from charging prime ministers with crimes for violations of Federal laws.
Add to this the tactical and strategic disadvantages the United States has suffered from blissful ignorance of the East Caribbean states; the People's Republic of China has used American absence to not only establish large embassies, from which they can conduct electronic surveillance upon the US, but has expanded its influence over local economies and cash-strapped governments. Unless the United States Depatment of Justice ramps up its enforcement programme in the East Caribbean, which is a hotbed of money laundering, corruption and white collar crime, the situation will not improve, and Americans and Europeans will continue to become victims of Caribbean crime.
Somebody in command over at Main Justice at DOJ needs to find out why there haven't been any significant indictments of East Caribbean money launderers in 2021.

Malta's population is 99% Roman Catholic, and the Church proscribes Adultery in the Sixth Commandment. Nevertheless, chronic infidelity has stained the reputation of the ruling Labour Party since the days of Dom Mintoff. Apparently, a secret life of philandering, such as Mintoff freely admitted in his memoirs, is the rule, rather than the exception, at PL.
One senior government minister had an affair with a blonde opposition MP; their affair was kept secret for a very long time. They used the Hilton for a rendezvous; she received a no-show job at MGA as one of the perks she derived from the trysts. When the official's wife found out that her partner was shagging the opposition, she kept it quiet because of her fears that there would be a negative reaction from her husband's fellow party members to her complaints. The affair, which was a favourite subject of conversation on certain WhatsApp chats, did eventually leak out. Why won't he obey the calls to resign ?
Another official, who carried on a drug-infused affair with a wealthy married man, who was himself also romantically involved with the secretary of the Chief of Staff at OPM, later sought to provide cover for him in the EU when the fur started flying in the Daphne investigation. She also received a "commission" which was not properly disclosed. She remains in office, notwithstanding calls to the PM to remove her.

These sins expose the violators to potential blackmail, and more importantly make them vulnerable to corrupt influences. They may be unable to resist "requests" to favour certain requests that they would no otherwise honour. In plain English, they might be forced to commit criminal acts, to keep their dark secrets buried. Those acts will usually involve injuring the interests of the voters who have elected them, to the tune of many millions of dollars lost in revenue, or securing an advantage in business that is at the expense of others. They are forced to use their government position for evil purposes.
Whatever the bad actors request of the cheater, it hurts the public interest in some way. Since the personal morality of the individuals above is lacking, the risk that they would be compromised is high. No wonder the levels of corruption in Malta, amongst government officials, exceeds any of the other Members of the European Union.

The US Attorney's office, SDNY, has delivered a status report to US District Judge Alison Nathna, who presided over US vs. Ali Sadr Hashemi Nejad, responding to her Order entered February 22, 2021, concerning whether the FBI's BIDMAS search processes do cause additional Brady violations in the District, and addressing what steps are being taken to insure that improper use of the FBI BIDMAS information system does not occur in the future. In the Sadr case, information uploaded by the FBI, regarding other unrelated IEEPA investigations in progress, was not timely conveyed to the defense, resulting a Brady violation.
In a six page report, signed by John McEnany, the District's Associate United States Attorney, containing details of the FBI's investigation into the case, his office reached the following conclusions and recommendations:
(1) An audit of the investigations that accessed BIDMAS (Bureau Investigative Document Management and Analysis) in the Sadr case did not find that any searches were outside the scope of the search warrants obtained in the case by the US Attorney's Office. Some BIDMAS data from other investigations,, however, was aggregated, resulting in potential violations.
(2) BIDMAS search results must be conducted with awareness of the obligations under the Fourth Amendments and Brady vs.Maryland requirements.
(3) Extensive training was conducted to insure that Brady violations do not occur in the future in other cases.
Readers who have the need to examine the scope of the audit, and the conclusions in more detail may want access the complete text of the August 17, 2021 letter below. A fair reading of the report indicates that the Brady violation occurred when the FBI researchers failed to alert the prosecutors that it had other materials which could constitute evidence requiring disclosure under Brady. The report asserts that this "blind spot" has been eliminated through adequate training procedures.
A fair reading of the report indicates that the Brady violations occurred due to the flaw in the BIDMAS system, and the failure of the investigating agents, in an overabundance of caution, to insure that everything obtained was disclosed to the defense in a timely manner.
