RENEWED DISCOVERY MOTION IN §782 CASE REFERRED TO FEDERAL MAGISTRATE JUDGE IN FLORIDA





The Discovery Application filed in the §782 proceeding seeking account information from three major US banks, for use in defending the pending Defamation case in St. Kitts against an American film production company, and its producer, who publicly alleged rampant corruption and illegal conduct in the country's CBI passport sales scheme, has been assigned, by a District Judge, to a Magistrate Judge, for a ruling. This is a common procedure; the Order requires the parties to first confer, to see whether the matter can be resolved. otherwise, the Magistrate must make a determination on the Application.

The defendants in the St. Kitts High Court action have filed a Defense to the Statement of Claim, pleading that their public statements and allegations were true, and factually accurate. The stated purpose of their Application is to gather evidence in support of their allegations, for use in the St. Kitts proceeding.
