JURISDICTIONAL NOTICE IN FLORIDA SUPREME COURT FACIAL RECOGNITION DISCLOSURE CASE

This is the notice filed by counsel for the defendant in the Florida Supreme Court case where the issue is whether law enforcement must disclose all the results they obtained in a facial recognition software system search, where the defendant was identified through that search.

The defendant is seeking to invoke what is referred to as Conflict Certiorari, where two District Courts of Appeal differ on a point of law.The First District held that law enforcement has no duty to make all the results from the facial recognition software search available to defense counsel. The petition to the Florida Supreme Court followed.
